Copyright (c) 2025 The AuthorsAdministrative sanctions regimes are pivotal legal tools that regulate the relationship between public authority and individuals and achieve the goals of justice and deterrence in the administrative field. This study aims to compare the two legal frameworks regulating the administrative sanctions regime in both Jordanian and Iraqi legislation, with a focus on the legal structures, procedures, and principles that ensure the protection of individual rights. The study seeks to highlight similarities and differences and propose development solutions that enhance the fairness and transparency of this system.
The study adopted a descriptive analytical approach by analyzing relevant legislative and jurisprudential texts and judicial rulings in both countries. It also used a comparative approach to uncover similarities and differences between the two systems and evaluate their effectiveness and legal guarantees.
The results showed a marked convergence in basic principles and procedural practices between the two systems, particularly with regard to legal guarantees and defense rights. However, fundamental differences emerged in the legislative structure, degree of practical application, and extent to which constitutional protection was included. The results also demonstrated the need for reforms between the two systems that enhance the efficiency of procedures and transparency of implementation, ensuring more effective administrative justice. Although the Jordanian and Iraqi systems are gradually moving closer to consolidating the values of justice and transparency, overcoming practical and legal obstacles remains a necessity to achieve an integrated administrative sanctions system.
