Copyright (c) 2025 The AuthorsThe legal framework relating to women's rights is constantly evolving, particularly in light of the challenges associated with achieving social justice and equality. The legal system reflects the obligation of States to preserve and promote fundamental rights. Based on this, this study aims to evaluate the adequacy of Iraqi and Jordanian legislation in protecting women's rights, by comparing the two legal systems and analyzing their degree of compatibility with international human rights standards.
The study adopted a comparative analytical methodology that addressed the basic legislative texts and relevant legal materials in both systems, using evaluation tools based on the principles of equality, justice, protection from violence, labor rights, and civil and political rights. The extent to which these texts are consistent with international obligations and standards related to women's rights was also examined.
The results showed that Iraqi and Jordanian legislation achieved tangible progress in several areas, most notably recognizing labor rights and providing protection from violence. However, both systems still need legislative updates to fill existing gaps and address theoretical problems and missing texts, thus enhancing compliance with global standards.
The study also revealed a marked disparity in the level of development and protection between the two systems. Jordanian legislation was found to be closer to international standards, while Iraqi law still requires further reforms, particularly in the area of equal civil and political rights.
The study concludes that there are legislative gaps in both the Jordanian and Iraqi systems that need to be addressed. It also recommends that these texts be subject to critical review by the competent authorities, with the aim of harmonizing them with international standards and promoting women's rights in a way that contributes to achieving scientific and legislative gains, and developing more just and efficient legal systems at the theoretical and applied levels.
